These terms and conditions are, wherever possible, in accordance with the law of New Zealand, but where a term of use contravenes statute, then the law will prevail.

You acknowledge that by loading a debt via the Easydebtcollection.co.nz website, you grant authority to Easy Debt Collection Limited or its subsidiaries to act on your behalf to act as debt collector on your debt.

You agree to ensure that registration details for your business are true and accurate and you have the authority to act on behalf of your business to engage the services of Easy Debt Collection Limited.

You acknowledge that all debts you load are true and outstanding at time of loading and your debtor is liable for these debts.

You have engaged the services of Easy Debt Collection Limited and agree to pay their fee as outlined when loading the debt and on the authority to act, should your debtor refuse to pay these whether or not the debtor is legally liable.

You undertake to inform Easy Debt Collection Limited immediately if you receive any communication and/or payment from the debtor by following the ‘Stop Collection’ steps as outlined via the ‘confirmation of debt’ email or via the Easy Debt Collection website portal. You acknowledge that by receiving any payment from the debtor or talking with the debtor about any payment plan you accept Easy Debt Collection Limited has met its obligations to you regarding this debt.

Should you accept settlement of the full or partial amount of the debt by means other than money ie. swapping of services, Bartercard etc, you accept Easy Debt Collection Limited has met its obligations to you regarding this debt.

You acknowledge that Easy Debt Collection Limited reserves the right to reject at any time during the process, debts presented for collection that do not meet with its criteria and/or contain incorrect, false or misleading information or are deemed uncollectable. In this case your collection fee as outlined when loading the debt will be refunded in full.

It is at the discretion of Easy Debt Collection to refrain from pursuing the debt through the legal system and/or lodging the debt with the Credit Bureau if the debt is deemed uncollectable. In this case your collection fee as outlined when loading the debt will be refunded in full.

Account Security

Easy Debt Collection Limited’s accounts require a username and password to log in. Members must keep their username and password secure, and never disclose it to a third party. Easy Debt Collection Limited does not accept any responsibility or liability leading to any interference, misuse or damage resulting from the breach of your account, whether within or out of your control.

Digital Communication

As part of the Easy Debt Collection Limited process we utilise digital communication including, but not limited to Email, Voice and SMS. We adhere to the ‘Unsolicited Electronic Messages Act 2007’ and the ‘TCF Mobile Messaging Services Code 2014’ to be compliant for all our digital communications.

Privacy

Easy Debt Collection Limited takes data privacy seriously. Please see our Privacy Policy to see how we collect and use personal information.

Amendments

Easy Debt Collection Limited reserves the right to amend these terms and conditions from time to time. Such amendments are effective immediate upon inclusion in this website.
